Tier1 post study work

Hello,
I completed my Masters in November, 2008 and I'm currently in India. My UK student visa expired on 31 Jan, 2008. I wish to apply for Tier 1 post study work from India.
Will i get the visa as i currently do not hold UK entry clearance?
